1. Acceptance of Terms
By completing my Google Form intake, accessing www.drjohantutoring.com, or booking my services, you agree to be bound by these Terms of Service. Throughout this document, "I," "me," and "my" refer to Dr Johan P. de Borst, PhD, MBA, BComm.
2. Inclusivity and Freedom of Expression
- Non-Discrimination: I provide a safe, welcoming learning environment. I do not discriminate on the basis of race, religion, gender, sexual orientation, age, or disability.
- Freedom of Expression: I respect your academic freedom. While I provide guidance on structure, logic, and argumentation, I respect your right to express your own ideas and viewpoints in your writing, provided they do not violate general ethical standards (e.g., hate speech).
3. Artificial Intelligence (AI) Policy
- Permitted Use: You may use AI tools for ideation, brainstorming, and structuring documents only.
- Prohibited Use: You must not submit work to me that has been written or generated by AI. My services cannot be used to "humanize," rewrite, or disguise AI-generated content.
- Refusal of Service: I reserve the right to refuse to review any document I suspect has been generated by AI. The writing must come from you to ensure you develop the critical thinking skills required for your degree.
4. Services Provided
I provide specialized academic tutoring, dissertation supervision, study planning, and proofreading.
- Delivery Method: Services are delivered via video call, email, and file exchange via a shared Google Drive folder.
- Ethical Standard: My services are educational. I do not write papers for students (contract cheating).
5. Communication and File Exchange
- Primary Channels: You agree to communicate primarily via WhatsApp and Email for scheduling and quick questions.
- File Management: You agree to use our shared Google Drive folder as the central repository for your drafts and my feedback. You acknowledge that while I take every precaution to secure my local devices, you also bear responsibility for keeping your own Google account credentials secure.
6. Pricing, Payment, and Cancellation
- Payment: Required in advance of sessions or upon package purchase.
- Refunds: Packages are non-refundable once the first session has commenced.
- Cancellation Notice: You must provide at least 24 hours' notice to cancel or reschedule. Less than 24 hours' notice may result in the session being charged at the full rate.
7. Student Responsibilities
- You are responsible for uploading your drafts to the Google Drive in a timely manner before our sessions.
- You acknowledge that final grades are the sole responsibility of the student. While I provide expert guidance, I cannot guarantee specific grade outcomes.
8. Intellectual Property
- My Content: All teaching materials I provide remain the intellectual property of Dr Johan Tutoring.
- Your Content: You retain full copyright and ownership of your dissertation and academic work.
9. Limitation of Liability
To the fullest extent permitted by law, I shall not be liable for any data loss due to third-party server outages (e.g., Google/WhatsApp) or indirect damages resulting from the use of my services.
10. Governing Law
- For students residing in the United Kingdom: These terms are governed by the laws of Scotland, United Kingdom.
- For students residing in the European Union and elsewhere: These terms are governed by the laws of Spain and applicable European Union regulations.
Any disputes arising under these terms shall be subject to the jurisdiction of the courts in the respective country determined by your residency.

- Academic Context: Degree level, dissertation topic/subject area, module details, and specific support requirements. (Note: I do not collect or store the name of your specific University.)
- Coursework Data: Drafts, essays, datasets, and feedback files exchanged during our tutoring engagement.
3. How I Store and Secure Your Data
- Shared Storage: We utilize a shared Google Drive folder to exchange files, accessible strictly by you and me.
- Local Storage: Files may also be stored on my personal computer hard drive to facilitate offline work and review.
- Access Control: I am the sole operator of Dr Johan Tutoring. No other individuals, employees, or subcontractors have access to my computer, your Google Drive folder, or your contact details. My devices are password-protected and kept secure.
4. How I Use Your Information
- To provide services: To review your materials via Google Drive and conduct 1-on-1 tutoring sessions.
- To communicate: To exchange messages, schedule updates, and quick queries via WhatsApp and Email.
- To personalize: To tailor my teaching methods to the specific needs outlined in your Google Form submission.
- To process payments: To manage billing and invoices.
5. Third-Party Tools and Processors
I do not sell your data. However, I use trusted third-party platforms to deliver my services. By using my services, you acknowledge that data will be processed by:
- Google (Workspace): For intake forms, file storage, and email.
- WhatsApp: For instant messaging and session coordination.
- Google Meet: For hosting our live video sessions.
- Stripe: For secure billing and payment processing.
6. Confidentiality and Mutual Non-Disparagement
- Strict Confidentiality: The service I provide is strictly confidential. I guarantee that I will never share your work, your identity, or details of our sessions with third parties, nor will I ever post about you or your academic situation on social media.
- Recording Policy: You may record our Google Meet sessions strictly for your own personal study use. You agree not to disseminate, upload, or share these recordings on any social media platform or with third parties.
- Mutual Non-Disparagement: You agree not to publish, post, or release any disparaging or negative comments regarding my services on social media or public forums. In return, I agree to never publish disparaging or negative comments regarding you or your academic performance.
7. Data Retention
I keep your information and our shared Google Drive folder only for as long as necessary to fulfill the tutoring engagement and for tax/accounting records. You may request that I delete your files from my Drive and hard drive at any time after our work is concluded.
8. Your Privacy Rights (GDPR)
If you are located in the UK or EEA, you have the right to:
- Request access to the personal data I hold about you.
- Request correction or permanent deletion of your data (including files on my hard drive).
- Withdraw your consent at any time.
